Organizational Performance Management Essay

Organizations across the board monitor performance in order to be profitable, and make their stakeholders happy, including healthcare organizations. The following paper will address similarities along with differences among three specific healthcare organizations; long-term care, VA hospitals, and community/public health systems. We will also discuss how each organization monitors performances, and how each organization achieves regulatory and accreditation compliance. Communication with leadership in order to align organizational goals, and compliance with regulations and development of risk and quality management systems will also be addressed. Long-term care, VA hospitals, and community/public health systems may be different in the patients that they treat, but overall they are fairly similar. The top priority of all three organizations is to care for their patients and stakeholders, and staff performance has to be top priority for the management team of any one of those three organizations. Long-term care usually requires more staff to care for the patients who are 65 or older, and in declining health therefore requiring a bigger management team usually consisting of a Director of Nursing, Assistant Director of Nursing, Registered Nurses, Licensed Practical Nurses, Certified Medication Aides, and Certified Nurse Assistants just for direct care to a patient. There is also the dietary department that makes meals for the patients, and if therapy is needed there are more people involved as well such as representatives for Medicare or Medicaid insurance since most elderly people are covered under one or both. Imagine having all of these people working for one patient, this is what happens in long-term care. Many people working as a unit to help individual patients. Most long-term care facilities are privately owned, and employ anywhere from a few people up to hundreds of people. The Department of Veterans Affairs (VA System), operates the largest health care system in the United States, and employs nearly 15,000 doctors and 61,000 nurses as of 2012. With such a large amount of employees it can be extremely difficult for the VA to have proper organizational management, and this in turn leads to poor performance, and is the reason for many of the problems that the VA System faces today. Community/public health systems have one main goal, and that is to ensure the overall healthy of the community. This can include diagnosing and investigating health problems or hazards, informing the community of those hazards or problems, enforce laws and regulations, and help those with low/no income find health care that the individual can afford. So rather than being an actual organization that is caring for individuals like long-term care facilities, or the VA system, the community/public health systems tries to take more of a preventative approach to health care. Long-term care, VA Hospitals as well as Community Public Health systems will monitor performance by following different steps the organizations come up with. First and Foremost everyone would come to the initial meeting to where they will discuss the performance process and come up with a plan together as a team. It will also allow for the employees to be monitored, which will be able to be reviewed. They will be monitored on the work that each employee is putting out and how they are contributing to the team and the organization. During the meeting we will come up with a plan: the plan will allow us to go over the job descriptions to determine what needs to be done as an individual as well as a team. The second objective would be to monitor the work of the employees and employers to make sure that they are doing the necessary steps that need to be done. We will also identify and barriers in which are keeping the employees from accomplishing the performance objectives and help them to achieve or overcome them. After monitoring the employers and employees we will then go into review which allows us to sit down and discuss the overall work in which they put out. Self-assessment will be given to the employees and employers to which they can grade themselves and assess how they have been doing in the organization throughout the year and how they can better themselves in the future wh ile working at the organization. However, the organizations achieve regulatory and accreditation compliance of each organization will help each organization by making sure that they are in compliance with up to date information and laws to better serve the patients and staff. For instance it will offer different services like Awareness, Education and Organization, which helps to create the awareness, obtain executive management commitments. It will also offer Assessment and Risk Analysis, Training, documentation and ongoing monitoring. By making sure each employee receive  the necessary classes and training they will be successful in achieving the organizational performance in which is set by the organizational team. By improving the overall organizational performance different things can be done from appraising and rewarding the necessary employees that do go over and beyond for the organization. Also, by making sure everyone is doing the necessary jobs in which need to be done by following the plan in which is set regarding the organizations. Leadership is critical to any organization such as Long-term Care, VA Hospitals, and Community/Public Health Systems. Without the importance of leadership, there would not be success in any organizations. According to The Joint Commission, the quality and safety of care provided by the organizations depends on many factors such as: A culture that fosters safety and quality The planning and provision of services that meet the needs of patients The availability of resources such as: human, financial, physical, and information for providing care A sufficient number of competent staff and other care providers Ongoing evaluation and improvement of performances Accreditation is an assessment process for the organizations that defines standards of acceptable operations and performances. The standards that deal with the outcome and performance issues are considered to be the most important standards to promote the healthcare quality improvements. The â€Å"Longtermcare.gov† website states that long-term health care effects nearly 70% of people over the age of 65. With such a large portion of the population using this type of health care it is important that the risk and quality management systems that are put in place are in fact bettering the care these patients are received. Risk and quality management systems help to ensure that patients are taken care of and protected. Some ways that states are ensuring this protection is by screening and evaluations, risk assessments, communication, education and staff training (Selid & Galantowicz, 2005). The unfortunate reality is that long-term care facilities do not always follow the risk and quality management systems that are put in place. What is more unfortunate is that the population that is served by this type of health care often does not have the ability to do something about it. Public Health System Public health systems effects every American every day, according to the CDC public health systems are responsible for, â€Å"Preventing epidemics and the spread of disease, protecting against environmental hazards, preventing injuries, promotes and encourages healthy behaviors, responds to disasters and assists communities in recovery and assures the quality and accessibility of health services (â€Å"Center For Disease Control And Prevention†, 2014).† The Federal Government is responsible for providing goals, standards and policies for state and local public health systems (â€Å"Center For Disease Control And Prevention†, 2014). One of the biggest jobs that the public health systems have are vaccinations, and infectious disease surveillance (â€Å"Center For Disease Control And Prevention†, 2014). 92% of local health departments carry out these jobs on a daily basis (â€Å"Center For Disease Control And Prevention†, 2014). Risk and quality management are also used to make the organization the best it can be. Although all three health care organizations main purpose is the health and wellbeing of patients they have many similarities as well as differences. The three organizations discussed are all ran by regulations and goals that help to shape the organization. Carrie Buck Essay

Buck versus Bell 274 U. S. 2000 (1927) was the United States Supreme Court ruling that upheld a statue instituting compulsory sterilization of the unfit, including the mentally retarded â€Å"for the protection and health of the state. † (Holmes) It was largely seen as an endorsement of negative eugenics which is the attempt of science to improve the human race by eliminating â€Å"defectives† from the gene pool. (Elof) Paul Lombardo argues (in N. Y. U. Law Review, April 1985, 60(30):30-62) that the Buck case was a milestone in government power over individual rights. Lambardo) In his essay â€Å"Carrie Buck’s Daughter: a popular, quasi-scientific idea can be a powerful tool for injustice,† Stephen Jay Gould attacks the injustice of the false â€Å"science† of eugenics, and champions Carrie Buck as the example of the victims. This paper aims scrutinized Gould’s writing skills by studying and analyzing the five metaphors he used in the essay. First, the comparison to Judeo-Christian (Exodus) and pagan Greco-Roman (philosopher Plato) ideas of punishment through 3 generations which is unjust will be tackled. Second, Carrie Buck is an instrument of showing the people what injustice is. Third, the references to Adolf Hitler and the Nazi’s policy of eugenics through gas ovens will be analyzed. Fourth, the issue of the dishonesty of the American legal system and the issue regarding Oliver Wendell Holmes will prove that government powers overpower the individual rights. This should not be the case. Lastly, the metaphor from the ballad â€Å"Barbara Allen† will be talked about. At the end this paper will also examine and evaluate whether Gould succeeded or not in his argument or persuasion essay Gould was a world renowned historian of science. (Shermer) This is why one believes that he uses metaphors that happened in history. He wanted to prove his arguments by relating to what has already happened in the past which is unique for a writer to do. The first metaphor was a comparison to Judeo-Christian and Greco-Roman ideas of punishment through 3 generations. In addition to that is the superstition of bad things happens in threes. One supposes that Gould wants the readers to realize the similarity of the ruling and the ancient beliefs. He argued though that the injustice here is that the children are innocent of the crimes of their fathers or grandfathers. (Gould) When Gould referred to Adolf Hitler as the perfect metaphor for evil, it could be he was coming from a point of view that no person in the history of the world had done what Adolf Hitler did and all for the reason of eugenics. Gould was also known to write about philosophical matters. He was clearly disgusted by the eradication of over 9 million people through gas ovens just because they were considered â€Å"imperfect. † (Gould) How could Hitler know what is perfect if he is imperfect? Surely, it seems illogical when one sees this argument. As for the issue of dishonesty of the American legal system were the victims were not told of sterilization and that the government falsified records was just plain unjust. The government does not have powers to undermine the rights of any individual. The individual is in the proper perspective to know how to better a government and a sense of bettering a society rather than one person holding a high office. That should better fulfill each individual needs and in turn produce a more controlled government. A government should be entirely equal to all citizens and each individual should make his or her own decisions. (Rousseau) One of the most notable documents in history tells of the necessity of individual rights and explains why those rights are a necessity. Individuals’ wants and needs could possibly be blind to the state running the government and everyday pleasures that many take for granted could quickly come to light once they were gone. Often, the state does not visualize this method and can sometimes ignore the individual’s needs all together when proposing things. This basically give power to the federal government to control and set laws for people instead of letting the individual think for him or herself and control their own actions. With having the states predominate control over individuals, problems often occur and the different laws and propositions could alienate some people. The Declaration of Independence originally established different rights for the population of the United States in which gave the people rights of freedom that the citizens needed and a norm to have a guide for the people. Plato’s â€Å"from Crito† is a document that established and guidelines to be held by the states instead of the individual. The Declaration of Independence sought for individual unlike the principles regarded in â€Å"from Crito†, in which saw the power of the government to be lead by the state. Over time people have swayed from the views of the Declaration of Independence and have abused their rights that were allowed to them. That should be no reason to have these freedoms taken from them. Individual rights are a must in society and are important in the function of everyday life. The individual’s rights should predominate and not the government powers. In fact, the government has defeated their purpose by doing acts like fraud and telling lies. (Rousseau) They have the responsibility to defend and protect the innocent and helpless against people that will try to harm them. In this case, the people who are harming the innocent are the ones that should have been protecting the victims. Gould argued that as we can see in the evidences that Carrie Bucker is a victim of this injustice. Gould also made a reference to the ballad â€Å"Barbara Allen†. The ballad was about two lovers who were united only in their deaths which is similar to what has happened to the mother and child in the Buck case. Carrie and Vivian Buck were reunited when they were already dead. Gould’s tone during this part was a person who mourns as if the two people were related to him. He was so disappointed in what happened in their lives and was disappointed that because of the injustice done by the government we see the end of the Buck lineage with Vivian. Stephen Jay Gould is one unique writer. What distinguishes Gould from other writers is that he has taken his work beyond academia and into everyday life. He takes certain aspects of information in history or in any topic that appeal to a general audience and makes them relevant to the here and now. Gould uses his unique style to condense the key contributions of influential figures into a single essay. He also uses his own seemingly mundane experiences to make larger points. In this essay, one could see that readers will be enthralled to read from the very first page. He uses ordinary language but this does not mean that the depth of his words and thoughts would suffer. One can also see that he uses different perspectives in looking at the problem and not just contained in his expertise. He definitely succeeded in this persuasion essay if what he really wants was to open the eyes of the public to the negative effects of eugenics in our lives. Gould captures the emotions of the readers by using information that is both scientific and historical. However, if one questions whether Gould was impartial or objective then one would say that he was impartial. Although he did not directly state it in the essay, one could feel his emotions when one is reading through the article. Gould has established an interesting point in this essay. It was fascinating to see how he had developed the theme and wrapped it up. The essay was like a more structured version of a good and intellectual conversation. Gould has his own unique philosophy of science that has influenced both his career and his life. That philosophy can best be summed up in a quotation from Charles Darwin, frequently cited by Gould as a sound principle of philosophy: â€Å"All observation must be for or against some view if it is to be of any service. † (Darwin) Gould has followed Darwin’s advice throughout his career and his extensive writings.

Asian American Literature Essay

The stereotype created of Japanese men as military foes combined nationalism with racism. Since their physique has always been considered small, the danger from the Japanese was perceived to come from the Japanese Superman, possessed of uncanny discipline and fighting skills. Films, often punctuated with racial slurs, were quick to paint Japan’s treachery in battle, its brutality, and disregard for international rules of war. These stereotypic images carried over to Japanese-American men outside the context of the war. Pearl Harbor and the war years enabled Hollywood to revive the yellow peril characteristics and the fear of miscegenation. By the end of the war, Americans had learned to associate brutality and treachery with a Japanese face. Caricatures of the Japanese were found in the cartoons of the period. Warner Brothers, Looney Tunes, created a duck version of â€Å"The Jap† who had glasses, buckteeth and cries â€Å"oh sorry, sorry, sorry† (with slurred r’s). They also created â€Å"Tokyo Jokio† and â€Å"Bugs Bunny Nips the Nips. † The buck-toothed Japanese became a standard cartoon figure. Max Fleischer created a Popeye the Sailor cartoon entitled â€Å"You’re A Sap, Mr. Jap†, which is a song Popeye sings over and over. This cartoon showed the Japanese deceiving Popeye, causing him to cry out righteously: â€Å"Double-Crossing Japanese† The portrayal of women during this period fared no better. The common stereotype was the â€Å"Dragon Lady,† â€Å"Geisha Girl,† and â€Å"Tokyo Rose,† who had a penchant for White men, dressed in tight dresses, and bodies on display. They are sly, cruel, exotic sex objects, or subservient and hardworking. Shirley Geok-Lin Lim, in â€Å"Feminist and Ethnic Literary Theories in Asian American Literature† comments on how â€Å"the image of Japanese-American women usually remains on the margin, invisible, mute or constrained to limited stereotypic images of passion. † The media played on these stereotypes to sell misleading images to audiences, who wanted entertainment that was different from their normal lives and were willing to see and accept anything exotic. The stereotypes of Japanese and Japanese-American women were pervasive in the media because the media perpetuated these stereotypes through their portrayal of Japanese and Japanese-Americans. Unfortunately, for some, they still carry over in the perceptions of the American people. Japanese-Americans are challenging the stereotypical images of the past and have made a voice for themselves in American society. They are fighting against the persistent racism and sexism against themselves by establishing a unifying identity as Americans and monitoring the media’s representations. Although ethnic stereotyping is less common today than it was in the last century, it persists. The images are not so obviously offensive; consequently, many people do not recognize them as stereotypes. In terms of dramatic expression, then, the Japanese film labors under a heavy burden. If it portrays emotion within the traditional Japanese framework, it may achieve authenticity, but the effect is antiquated. If it portrays emotion within the Western framework, it comes across as meretricious and unconvincing. Films that try to blend the two modes often end up antiquated and unconvincing. Yet in animation, which lacks visual realism and features de-Japanized characters to begin with, the expression of emotion paradoxically takes on a more convincing sense of reality. This may explain why most of the serious and ambitious film efforts have used the vehicle of anime. Given the serious dramatic deficiency, Japanese live-action films can no longer tackle any serious or profound subject matter. In the context of contemporary Japanese film, then, anime often conveys a greater sense of reality than live-action films. The thin, insubstantial reality of animated film, that is to say, is more alive — literally, more animated — than the flesh-and-blood reality. And if anime is perceived as more real (i. e. , closer to physical reality) than live-action, this means that, increasingly, anime embodies the Japanese consciousness of reality. The Japanese conception of reality is undergoing a process of animation. The rise of anime as well as manga is a cultural by-product of modern Japan’s tendency to promote modernization and Westernization while rejecting its history and traditions. A medium that fuses elements of East and West, and lacks a clear national identity, could be considered international in a certain sense, and this is doubtless a major reason why anime has so many fans overseas. But the current state of affairs, in which anime represents the mainstream of Japanese cinema, is by no means desirable, inasmuch as it signifies an ever-widening gap between physical reality and people’s conception of it.

Gandhi's ethic of nonviolent civil disobedience - Essay Example The Holocaust and more recently, the attacks on the World Trade Center may be considered as examples of an unfortunate inversion of sacred beliefs and moralities, that led to the attempted annihilation of two distinct groups of people and their cultures. In the first instance, it was the Jews, who were the target, and in the second it was the American people. The responsibility for these two subversions of the holy can be narrowed down and fixed on two powerful personalities, Adolf Hitler and Osama bin Laden. But what motivated these two to such actions'Hitler firmly subscribed to the belief that the Germans were of Nordic/Aryan origin, and were a superior race; if they mixed with the inferior race of Jews, racial purity would be diluted. (Jewish Virtual Library, para 4) This view may have also been exacerbated by his personal dislike of Jews; he felt they, along with the Communists, (most Communists were Jews too!) were responsible for the defeat of Germany in the First World War, a defeat that led to the Fatherland's total humiliation. In the spirit of a Plato advocating regulated breeding of humans to ensure better 'quality', Hitler went a step further by advocating ethnic cleansing, which would set the stage for building a strong and pure Nordic race. Hitler gave his eugenic program a 'scientific' base too. He referred to Nietzsche's and Darwin's theories to justify it. He firmly believed that he would be helping to achieve the evolutionary ideal of getting the best to survive by wiping out the inferior Jewish race. (Brief History: Evolutionary Theory)The Jews were first isolated in ghettos in order to be stopped from 'polluting' the pure Nordic race. The next step taken by Hitler was to exhort his countrymen to partake in a cleansing pogrom devised for the complete annihilation of the Jews. And Hitler, being the demagogue that he was, was also able to co nvince his compatriots that it was a sacred duty to wipe out an inferior race, thus paving the way for making Germany a great country.As for Osama, his belief was (is) that Islam is the only true religion, and Mohammed, the only Prophet, and all those who did not agree were infidels. It was God's great plan that the infidels should be wiped out through the process of 'Jihad' (Holy War). It was a devout Mussalman's sacred duty to kill or forcefully convert the infidel to Islam. '''''As Fasching says: Bin Laden and the al Qaeda, according to a discovered terrorist manual, are clear about the goal - "overthrow of the godless regimes and their replacement with an Islamic regime." This goal authorizes Muslims to kill Americans and all unbelievers. The killing of even innocent women and children is not only permitted but religiously required. (2002) Bin Laden justified his aggressive anti-American stand by stating that the Americans caused offence to Islam and its followers by their very presence in the Holy Land (Saudi Arabia) during the Gulf War of the early 1990's. The most holy of Islamic sites are located in Saudi Arabia, and Islam forbids a non-Muslim to visit these sites (Mecca, for instance) even under normal circumstances of peace. Thus the presence of American soldiers during the war was seen as a wanton desecration of the Holy Land of Islamic tradition. Since the disease was diagnosed, in New York City alone, over one hundred thousand people have died from the disease since the year 1981. As of February 2014, there were 110,736 new Yorkers who had been diagnosed with aids and presumed to be living with this infection. In the year 2013 3481, new diagnoses of these diseases were made of these: 76.6 percent of the people were men with 23.4 percent being women. 48.3 percent is made up of men who have sex w ith men, while the heterosexuals were made up of 21.4 percent. Hispanic and blacks made the larger population of people affected with aids with a percentage of 78.6 percent. Lastly, 35.1 percent of the new infections were comprised of people who are under the age of 29. 1.4 percent of new Yorkers live with aids, with the Spanish and black Americans being the most affect since they represent about 78 percent of this population. Young people rate of infection follows closely at 35.1 percent. This percentage is quite high now that these young people are more active and likely to spread the disease more than when it affected older people. Aids is a thorn that has to be dealt with accordingly in order to mitigate its effects on the disease burden and various sectors of the New York City. Its effects are far felt in all areas that work towards maintaining the great economy of the city.

Section 2-Employers liability for compensation (1) Where an employee sustains personal injury by accident arising out of, and in the course of employment, the employer is liable, subject to this Act, to pay compensation in accordance with this Act. (2) An injured employee shall not suffer a diminution in earnings while the employee undergoes treatment for injuries sustained through an accident arising out of, and in the course employment. (3) Where an attending medical officer assesses an incapacity in respect of an injured employee, the employer shall pay the injured employee compensation commensurate with the incapacity so assessed. (4) Subject to sections 3 and 4, where the injury results in death or serious and permanent incapacity, the Court on consideration of the circumstances, may award the appropriate compensation under this Act. (5) The employer is not liable to pay compensation in respect of an injury to an employee resulting from an accident which is attributable to the employee ha ving been under the influence of drink or drugs at the time of the accident (6) For the purposes of this Act, an accident resulting in the death or serious and permanent incapacity of an employee arises out of and in the course of employment, (a) although the employee was at the time when the accident happened acting in contravention of a statutory or any other regulation applicable to the employment, or was acting without instructions from the employer; (b) if the act was done by the employee for the purposes of and in connection with the employers trade or business. (7) Compensation is not payable under this Act in respect of incapacity or a death resulting from a deliberate self-injury. (8) Compensation is not payable under this Act in respect of an inc apacity or a death resulting from personal injury, if the employee has at any time represented to the employer that the employee was not suffering or had not previously suffered from that or similar injury, knowing that the representation was false. Section 3-Compensation in fatal cases (1) Where death results from the injury, (a) if the employee leaves dependants, the amount of compensation shall be a sum of money equal to sixty months earnings: but where in respect of the same accident compensation has been paid under section 5, 6 or 7, there shall be deducted from the sum payable under this paragraph the sums so paid as compensation; (b) whether the employee had dependants or not, the employer shall pay the medical expenses; (c) if the employee did not leave dependants, the employer shall bear the expenses of the burial as required by custom; (d) if the employee left dependants, the employer shall bear the expenses of the burial to the sum of five million cedis or as stipulated in the relevant Collect ive Agreement, whichever is the higher. (2) Where an employee survives an injury, whether the employee has dependants or not, the employer shall pay the medical expenses in respect of the injury. Section 4-Employer to pay medical expenses In an injury under this Act, the employer shall pay the medical expenses in respect of the injury. Section 5-Compensation for permanent total incapacity Where permanent total incapacity results from the injury the amount of compensation shall be a sum of money equal to ninety-six months earnings. Section 6-Compensation for permanent partial incapacity (1) Where permanent partial incapacity results from the injury the amount of compensation shall be, (a) in the case of an injury specified in the Third Schedule, a percentage of the compensation which would have been payable in the case of permanent total incapacity specified in the Third Schedule as being the percentage of the loss of earning capacity caused by that injury; and (b) in the case of injury not specified in the Third Schedule, a percentage of the compensation which would have been payable in the case of permanent total incapacity and proportionate to the loss of earning capacity permanently caused by the injury. (2) Where more injuries than one are caused by the same accident, the amount of compensation payable under this section shall be aggregated, but shall not exceed the amount which would have been payable if permanent total incapacity had resulted from the injuries. Section 7-Compensation for temporary incapacity (1) Where a temporary incapacity, whether total or partial, results from the injury, the compensation shall be the periodical payments or a lump sum of money calculated accordingly, having regard to the probable duration, and probable chan ges in the degrees, of the incapacity. (2) The periodical payment shall be the difference between the monthly earnings the employee was earning at the time of the accident and the monthly earnings which the employee is earning or is capable of earning in any other suitable employment or business after the accident; but (a) the aggregate of the periodical payments or the lump sum of money payable under this subsection shall not exceed the lump sum of money which would be payable in respect of the same degree of incapacity under section 5 or section 6, if the incapacity were permanent; (b) a period of absence from duty certified necessary by a medical practitioner shall be regarded as a period of temporary total incapacity irrespective of the outcome of the injury and a period subsequent to the first period but preceding the final assessment of disability shall be regarded as a period of temporary incapacity; (c) the maximum duration of periodical payments under this section shall not exceed twenty-four months except where the chief labour officer directs the continuance of periodical payments during the continuance of a disability for a further period not exceeding six months; (d) a lump sum of money payable under section 5 or 6 shall not be disturbed by r eason of periodical payments having been made under this section in the event of permanent incapacity following or after temporary total incapacity or temporary partial incapacity. (3) In fixing the amount of the periodical payment the Court may consider a payment, an allowance or a benefit which the employee may receive from the employer during the incapacity. (4) On the ceasing of the incapacity before the date on which a periodical payment falls due, a sum of money proportionate to the duration of the incapacity in that period is payable in respect of that period. (5) Where an employee in receipt of periodical payments under this section intends to leave the neighbourhood in which the employee was employed, for the purpose of residing elsewhere, the employee shall give notice of that intention to the employer who may agree with the employee for the redemption of the periodical payments by a lump sum of money or for the continuance of such periodical payments. (6) Where the employer and the employee are unable to agree, either party may apply to the Court which may order a redemption and may determine the amount to be paid or may order the continuance of the periodical payments. (7) A lump sum of money so ordered to be paid together with the periodical payments already made to the employee shall not exceed the lump sum which would be payable in respect of the same degree of incapacity under the section 4 or 5, if the incapacity were permanent. (8) Where an employee in receipt of periodical payments unde r this section leaves the neighbourhood in which the employee was employed, for the purpose of residing elsewhere, (a) without giving notice as provided in subsection (5), or (b) having given the notice leaves the neighbourhood without having come to a n agreement with the employer for the redemption or continuance of the periodical payments, or (c) without having made an application to the Court under subsection (6), the employee is not entitled to the benefits under this Act during or in respect of the period of absence. (9) Where the employees absence from the neighbourhood exceeds six months without justifiable cause, the employee shall cease to be entitled to the benefits under this Act. Section 8-Compensation for desfiguring injuries (1) Where in an employment personal injury of the description specified in an entry in the first column of the First Schedule by accident arising out of and in the course of the employment, is caused to an employee, the employer shall pay as compensation an amount of money for the injury determined by a medical practitioner recognised by the Government, not exceeding the percentage of the compensation payable in the case of permanent total incapacity that is specified in the corresponding entry in the second column of that Schedule. (2) The compensation payable under subsection (1) is irrespective of whether or not a compensation is payable under any other provision of this Act; but a mutilation in respect of which compensation is provided under the Third Schedule shall not rank as disfigurement under the First Schedule. (3) Where more injuries than one are caused by the same accident, the amount of compensation payable under this section shall be aggregated, but shall not exceed the amount which would have been payable if permanent total incapacity has resulted from the injuries. Section 9-Method of calculating earnings (1) For the purposes of this Act, the monthly earnings of an employee shall be computed in the manner that is best calculated to give the rate per m onth at which the employee was being remunerated during the previous twelve months if the employee has been so long employed by the same employer, but, if not, then for a shorter period during which the employee has been in the employment of the same emplo yer. (2) Where by reason of the shortness of the time during which the employee has been in the employment of the employer, or the casual nature of the employment, or the terms of the employment, it is impracticable at the date of the accident to compute the rate of remuneration, consideration may be given to the average monthly amount which, during the twelve months previous to the accident, was being earned by a person of similar earning capacity in the same grade employed at the same work by the same em ployer, or, if there is a person who is not so employed, by a person of similar earning capacity in the same grade employed in the same class of employment and in the same district. (3) For the purposes of subsection (1), employment by the same employer m eans employment by the same employer in the grade in which the employee was employed at the time of the accident, uninterrupted by absence from work due to illness or any other unavoidable cause. (4) Where the employee had entered into concurrent contract s of service with two or more employers under which the employee worked at one time for one employer and at another time for another employer, the monthly earnings shall be computed as if the earnings under those contracts were earnings in the employment o f the employer for whom the employee was working at the time of the accident. (5) The earnings of the employee under the concurrent contract shall be disclosed to any other employee at the time of engagement with the latter and shall be taken into account only so far as the employee is incapacitated from performing the concurrent contract. (6) On the request of the employee to the employer liable to pay compensation, that employer shall furnish in writing a list of the earnings which have been earned by t hat employee on which the amount of the monthly earnings may be calculated for the purposes of this section. Section 10-Persons entitled to compensation (1) Compensation is payable to or for the benefit of the employee, or where death results from the injury, to or for the benefit of the employees dependant as provided by this Act. (2) Where a dependant dies before a claim in respect of death is made under this Act, or, if a claim has been made, before an order for the payment of compensation is made, the legal personal representative of the dependants do not have a right to payment of compensation, and the claim for compensation shall be dealt with as if that dependant had died before the employee. Section 11-Distribution of compensation (1) Compensation payable where the death of an employee resulted from an injury shall be paid to the Court, and the Court may order the sum of money so paid (a) to be apportioned among the dependants of the deceased employee or any of them in the proportion determined by the Court, or (b) in the discretion of the Court, to be allotted to any one dependant, and the sum of money so allotted to a dependant shall be paid to the dependant or be invested, applied or otherwise dealt with for the dependants benefit in the manner determined by the Court. (2) Where, on an application made in accordance with the Rules, it appears to the Court that, on account of the differences of the circumstances of the various dependants, or for any other sufficient course, an order made under subsection (1) ought to be varied, the Court may make an order for the variation of the former order appropriate in the circumstances of the case.

Personal information has become the biggest issue around the world, either processing or protecting it. But, in this article, the focus is on the health care system which is the Electric Health Record system (EHR), it is a system use to record health information electronically. Having the legislation, rules and regulation in place, it is found that this system has failed to provide protection on personal data. As a matter of fact, this system has managed to be exploited by unauthorised people. The EHR system was not fully tested accordingly to meet the end-users requirement, but released to the health service for use. The growth of data loss is increasingly common among the organisations in day to life and challenges in protecting personal data have emerged. It is therefore essential that health care service establ ish a better security policy to protect the personal data. This research paper will explain the security issues need to be enforced in order to protect data from the vulnerabilities. 1. INTRODUCTION One of the most significant current discussions in legal and moral philosophy is the security of data. It has become a central issue for many organisations to achieve a successful information system within defined scope, quality, time and cost constraints in order to protect privacy, confidentiality and security. Researchers like Olvingson et al. (2003) suggest that there have been drastic changes in the provision of health services since the introduction of computers about three decades ago and issues related to the protection of personal health information have resulted in both technical research and political debate.[1] Thus, it can be justified that security of data is still the leading cause of failure in software system development. The main issues addressed in this paper are personal information, data protection and security. It has been divided into four parts. The first one deals with the explanation of personal data, data protection and disclosure of data. The second part is to evaluate the risks and the impact on information system. The third one is to present different approaches to counter these risks. The forth one is to provide a summary of findings that can be use as lessons in the future. The purpose of this paper is to review the latest years of research into these parts and critically evaluate and validate this case study. 1.1 What is personal data? Personal data can be classified into three main categories; these are contact, profile and behavioural information. It contains the detail information of a living person that is unique to each individual. In this scenario, the personal data reveals the information of individuals health such as name, racial origin ,blood group, sex, DNA, contact details, next of kin, illnesses, treatment and General Practitioners detail. Therefore, EHR system functions at its best to record and transmit this information throughout the health service organisations. But, the biggest challenge of this system is to protect the privacy of patients health information. The main question addressed in this paper is how to protect this sensitive data. According to Croll.P.R (2010), he discusses that the effectiveness of Privacy and security measures depend mostly on the policies adopted by the healthcare organisation.[2] It can be argued that research shows that there is inadequate policies enforce by the gover nment and the medical organisation to prevent further harm on personal data. It can just be suggested that future research should determine how to address these issues effectively and generate effective security policies in IS project development 1.2 Data Protection Act is a legislation that has been established since 1984 and replaced in 1998, it is an Act to protect personal data. The principles of this Act are to make sure that data is accurate and correct. Information should be fairly and lawfully processed. Personal data should not be kept longer than necessary and processed for limited purposes. It should be adequate, relevant and up to date. The most important ones are not to reveal personal data in any manner and should be secure. Personal data should be processed in accordance with the data subjects rights. This Data Act also emphasizes on the accessibility of data, that is to say who is allowed to access to the data and under what conditions. Liability is crucial because it is about who is responsible if the data is abused. Haasa S. et al (2010), they argue that even if the providers policy states that data protection regulations and legislation are met, patients cannot control the EHR providers usage of their data. [3] Thus, it can be discussed that EHR system is not a single medical institution anymore and it is run by other enterprises who maintain the electronic records system where they have access to the personal data and able to disclose private information to other third parties. According to this article, the National Health Information Network (NHIN) and Health Insurance Portability and Accountability Act (HIPPA) cannot guarantee the security of health records because they are not sure people working within the medical organisation will abide by the rule. 1.3 Disclosure of Data is the revelation of data; it can be either wanted or unwanted disclosure. This means that one can either reveal the personal data to the authorised party or to the third party that could be unauthorised without any conditions. But, this paper focuses on the risks that are associated with the data that is disclosed inappropriately. Researchers have found that the in-house sabotage is the leading cause of sharing information to the third parties. It is the most common risk factor that has been identified by recent studies so far. An example of this potential risk of harvesting personal data for commercial purposes is the CAMM scam in Australia, 2003. It is a company promoting pharmaceutical activities and manages to upload the EHR system where they extract the personal data with some doctors approval. [4] Later, it was found that CAMM did not just use it for the pharmaceutical purposes, but also sold it to many insurance companies and to other organisations that wanted to buy the data. Hence, it can be argued that this can cause significant threats to patients privacy. Concerns have been raised by several bodies about the poor regulatory structures and policies implementing by the government in protecting personal data. The other associated risks are hackers, natural disaster, terrorism and viruses. According to the case study, the fact and figures shows that 99% were the staff that had the opportunity to target the system and 88% of the organisations had lost money between 500 dollars to 10 millions of dollars.[5] The most surprising fact is when staff leaves the organisation, they are the one who become the attackers of the company. Security breaches mostly when there is lack of access control which leads to information technology sabotage. Angus N (2005) argues that if it is for the benefit of the patient, information can be shared within the multidisciplinary team caring for the patient and does not apply to research, teaching or other unqualified members.[6] Thus, it can be justified that information should only be disclosed appropriately and safely to the people required or authorised by the legislation and hence this will improve the security issues. 2. Evaluation of the risks and impact on information systems This part of the discussion is about the evaluation of the risks listed above and the impact on information systems in terms of storage, transport, access management and disclosure are as follows: Storage -The idea of the freedom people working anywhere has in fact increase the ability to carry data on portable hard drives, laptops and USB sticks. Recent report has confirmed that data leakage have become very common among the organisations and has great impact on the relationship to customer due to the loss of laptops and USB. For example the case of the PA consulting who transferred the personal data of 84,000 prisoners in England and Wales to a memory sticks that gone missing. [7] This was a total disaster in terms of money loss and identity frauds. There is increasing concern of shopping on line because of security which is the major perception whether to buy or not to on line. Recent developments in using credit cards have heightened the need for better security policy to protect personal bank details from hackers. Transport -The crucial thing is when electronic data is carrying insecurely in public domain and from one domain to another. That has an inverse impact on infor mation systems such as people will lose confidence in using the system. Economically speaking, the risks to organisations have grown immensely where consumers and businesses suffer from loss of availability, integrity and confidentiality. If any of these is loss either accidentally or deliberately, this will affect the organisations productivity, popularity and much more. According to this case study, the health service system is more networked and that lead to an increase of intrusion and malware. The statistic research shows that health care companies in United States had an average of 13,400 attacks per day at the end of 2009, according to the Secure Works where some of these attacks are hacking credit card and others are automated attacks from malware which infect computers via networks and USB sticks. [8] In UK, late 2009, there were three London Hospitals that were forced to shut down their computer networks due to the infected malware known as Mytob. [9] It can be argued that has an adverse impact on NHS because 4,700 computers were infected and it took about two weeks to eliminate the virus which was cost-effective and data loss.[10] These attacks can also result in wrong diagnosis of patients and even cause death if the patients information have been erased or mislead by the malicious attack. Access Management is about the authentication process which deals with the authorization of user sID and password to have access to the data. Concerns have been raised by several bodies about the poor password management. This means that passwordword is not changed regularly and has the same default fixed password which in turn makes the system vulnerable to most attacks. In fact, this scenario states that the user do not need to have administrator access to do serious damage to the health records. McSherry (2004) suggests that with the growing effectiveness of data retrieval engines and data mining techniques, personal data has become vulnerable to unauthorised people. [11] It can be argued that data kept electronically makes it easier to exploit by data thieves and other intruders. Even when I started preschool and kindergarten, boys were not boys to me; they were simply new friends and more people to play with. My parents and relatives were talking and admiring my baby brother Mike, and my sister and I played with dolls in the corner.
